HB 1160 ”Unlawful Detention of U.S. Citizens” introduced by Bob Marshall, R-13th District.
As introduced HB 1160 would prevent any agency, political subdivision, employee, or member of the military of Virginia from assisting an agency or the
armed forces of the United States in the investigation, prosecution, or detainment of a U.S. citizen in violation of the Constitution of Virginia. This legislation cleared the Courts of Justice committee by 6-3 vote and now goes to the floor. Remember, the National Defense bill gave Obama the power to arrest and detain any citizen of the U.S. he or his administration “deems” a terrorist without due process of law.
This legislation is important as it will act as a buffer between the state and the federal government. Please contact your Delegate and ask them to vote YES.
HB 614 ”Comprehensive Plan To Control Land Use” was introduced by James M. LeMunyon, R-67th District.
As introduced the bill would require that whenever a local planning commission recommends a comprehensive plan or part thereof for the locality and such plan has been adopted by the governing body, that the plan will control the future land use decisions of the governing body and no zoning amendment will ever be approved unless it is in accordance with the adopted comprehensive plan.
This is the reality of how Agenda 21 is being implemented in Virginia. Please contact your delegate and tell them to Vote NO if this comes to the floor. We don’t need Richmond meddling in our local planning. In addition to contacting your local Delegate, please contract Delegate Onzlee Ware at 804-698-1011. He is on the Counties, Cities and Towns Committee where this piece of dreadful legislation now rests.
We need to let Richmond know that a yes vote on this kind of bill means a NO vote for re-election.
SJ3 and HJ3 These bills represent the last hurdle for Virginia to get an Amendment to our Constitution that would control the abuse of eminent domain. Please keep up the pressure for passage. Lobbyist and powers that be are working over-time to prevent passage. Only pressure from voters will get these passed so that we can get the amendment on the ballot.
HB825 introduced by Bob Marshall, R-13th District. This is a shorter version of a previous bill introduced regarding the use of foreign laws in Virginia court decisions. Delegate Marshall’s bill would allow the use of foreign law in court decisions if any federal or state law authorizes the consideration of such foreign laws.
HB631 introduced by Delegate Rick Morris of 64th District. As introduced this bill would make any ruling or decision, that violates public policy of the Commonwealth for a court, arbitrator, administrative agency, etc., in whole or part that based its ruling on foreign law that violates a person’s rights guaranteed by the U.S. Constitution or Virginia constitution, void and unenforceable. Delegate Morris’ bill also covers rulings on contracts and business entitles. He includes an exception for churches, religious sects or society or denominations that are purely ecclesiastical in nature when the extent of jurisdiction by the courts of Virginia over such matters would be contrary to the rights guaranteed by the U.S. or Virginia Constitution.
This bill also contains language that says that “any provisions in the bill shall not be construed to conflict with any federal treaty or other international agreement to which the U.S. is a signatory to the extent that such treaty or agreement has control over Virginia laws.”
CAIR is against both versions and now other legal entities are coming out against both HB631 and HB825. One or both of these bills deserves our attention. I personally support HB631 but you need to read both and make up your own mind. Either way, contact your Delegate and support AMERICAN LAWS FOR AMERICAN COURTS.
NOW, FOR A HAPPY NOTE TO VIRGINIA GUN OWNERS: After a long, long battle for gun rights in the Commonwealth, the unconstitutional one gun a month rationing program has almost come to its deserved death. The Virginia Senate voted 21-19 to remove this infringement on our 2nd Amendment rights. But will McDonnell sign it? He voted for the passage of one-gun-a-month almost 20 years ago.
Call Governor McDonnell at 804-786-2211 and ask him to sign the bill. (HB940 and SB323) This will be a great victory for gun owners in Virginia.
