Hiring more ATF agents, increasing research into so-called “smart gun” technology, adding further state recorders to the federal background check system, and making that system operate around the clock, are all included in Obama’s executive order.
The way I understand this unconstitutional order, it allows the BATF to determine who qualifies as a gun dealer operating without an Federal Firearms License. If you sell one firearm without a dealers license, you can be prosecuted.
According to Iranian Jarrett it depends on the facts whether “you’re engaged in the business”.
“On factors such as: whether you represent yourself as a dealer, such as making business cards or taking credit card statements. Whether you sell firearms shortly after they’re acquired or whether you buy or sell in the original packaging.”
What constitutes a business card? Does it mean if you give someone a card with your name and number printed on it, you’re handing out business cards and you’re a gun dealer?
I have cards with my name & number on them, and I also own a pair of scissors. That doesn’t make me a beautician.
What if you purchased a firearm and discovered the next day, the caliber was too much for you, or you simply changed your mind and decide to sell it, are you dealing in firearms?
What if you purchased a limited edition firearm 20 years ago and have kept it “New in the Box” with all papers, and now decide to sell it to a collector; are you a firearm dealer?
Suppose you own a candy store and accept credit cards at you business, someone offers to buy an old firearm you have no use for; if all that person has is a credit card and you accept it, are you gun dealer?
Iranian Jarrett also announced that Obama would require the Social Security Administration to begin the rule–making process for prohibiting certain Social Security recipients from legally obtaining guns, a move that could bar millions from legally owning firearms.
If you are unable to manage your own affairs due to “marked subnormal intelligence, or mental illness, incompetency, condition, or disease” – which could potentially affect a large group within Social Security, you can’t own a firearm.
The Department of Veterans Affairs, as well as Social Security, frequently assigns someone else, often a family member, to handle the person’s finances. This triggers a report to the FBI’s National Instant Criminal Background Check System (NICS) that the person is “incapacitated.” Under the law, any such person is barred from buying or owning guns. The law also applies to family members living under the same roof.
If 90 year old granny can no longer handle her finances and she lives in your home, YOU CAN NOT OWN A FIREARM.
Marked subnormal intelligence – “mental defective”. That can be anyone who disagrees with Obama and his policies.
Incompetency – lack of physical or intellectual ability or qualifications. This is Obama and his entire administration.
Condition – a way of living or existing. If you’re confined to a wheelchair, you have a condition and can not own a firearm. If when you sneeze you wet your pants, you have a condition and can not own a firearm.
Disease – set of signs and symptoms that may affect the whole body or any of its parts. Cancer, Diabetes, Fibromyalgia, Arthritis, Heart Disease, Chickenpox, Mumps, Measles, Crohns, HIV, AIDS, and the list goes on, and on, and on. Read the list of diseases
Obama will use Social Security (part of Medicare – Medicaid) to look at your medical records and determine if you should be listed on the NICS’s list.
You can call me absurd, but use your own common sense. Read between the lines. This is disarmament by denying you your 2nd Amendment and God given Right.
THIS IS not only Discrimination but GUN CONFISCATION under the table. What is it going to take before everyone realizes Obama is not a friend, he’s our worse enemy!
Laura Ingraham interviewed John Lott who quoted then-Senator Obama as saying, “I don’t believe people should be able to own guns.”
Another article at Freedomoutpost quoted Obama as saying, “Ordinary men and women are too small-minded to govern their own affairs.”
People, watch what you say to your doctors because they write everything down. You could inadvertently be giving away your freedom.
This executive order has nothing to do with stopping crime and everything to do with Entrapment, Discrimination, your 2nd Amendment Rights and Gun Confiscation.
Let’s hope this never comes to pass because whatever Obama does with his left hand, you better be keeping an eye on his right hand also.
Virginia is under no Constitutional obligation to enforce Obama’s unconstitutional executive efforts to destroy our 2nd Amendment. In 1992, the Supreme Court (NY v US, 488 US 1041) ruled that Congress may not simply commandeer the legislative processes of the States by directly compelling them to enact nd enforce a federal regulatory program.
